1. ACCEPTANCE OF TERMS
By purchasing a TRC Learning Portal Membership, Program, Event ticket, 1:2:1 coaching, consulting as a “BUYER” of Thrive Right Consulting, wherein you are granted access to the TRC Learning Portal Programs and Documents, TRC online social communities, and/or TRC Virtual, Hybrid or Online Events as a registered user (“User”, “You”, “Yourself”, “Your”), You agree to be bound by these Terms, which You acknowledge that You have read and understood.

We reserve the right, at our sole discretion, to change, modify or otherwise alter these Terms at any time. You must review these Terms at https://thriverightconsulting.com/terms-of-service on a regular basis to keep Yourself informed of any changes.

2. EARNINGS AND INCOME DISCLAIMER:

Thrive Right Consulting (“ Hereinafter TRC”) can not and does not make any guarantees about your ability to get results or earn any money with our ideas, information, tools, or strategies.

You should know that all products and services by our company are for educational and informational purposes only. Nothing on this page, any of our websites, or any of our content or curriculum is a promise or guarantee of results or future earnings, and we do not offer any legal, medical, tax or other professional advice. Any financial numbers referenced here, or on any of our sites, are illustrative of concepts only and should not be considered average earnings, exact earnings, or promises for actual or future performance. Use caution and always consult your accountant, lawyer or professional advisor before acting on this or any information related to a lifestyle change or your business or finances. You alone are responsible and accountable for your decisions, actions and results in life, and by your registration here you agree not to attempt to hold us liable for your decisions, actions or results, at any time, under any circumstance.

3. PURCHASES AND PAYMENT

Your purchase authorizes you only to access and use the TRC Learning Portal Memberships, Programs, Trainings, 1:2:1 Coaching/Consulting sessions or ticket access options to live training events hosted by TRC. Sharing of purchases is not permitted and will be considered unauthorized, an infringing use of our copyrighted material, and may subject violators to liability.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in U.S. dollars.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, per business, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

If payment for a course is declined, our system will automatically disable access to our premium materials. (We understand. This usually happens because a credit card expires.) We want to help restore your access, so we’ll make every attempt to contact you to help resolve this issue. Once the billing issue is resolved, we’ll restore access.

PAYMENT VIA CHECK

All checks are held for 10 business days. Orders placed with a check will be held for 10 business days. Once 10 business days is complete, the order will be released.

All returned check will be charged a $25 USD return check fee.

Counter checks will not be accepted.

Checks and money orders must be sent in US funds.

PAYMENT PLANS

If any instalment payment should default, the Client will have seven (7) days to rectify the situation. Any scheduled coaching session(s) will be postponed until payment is received within the 7 days, all discounts and bonuses will be forfeited and full payment will apply. If a Client should default on any installment payment, the result may be cancellation from the Program and the Cancellation Policy will apply. An N.S.F. or credit card decline will result in penalty from our payment processing company in cases of payment default.

CREDIT CARD CHARGES AND CREDIT CARD FRAUD PENALTIES
Buyer warrants that he or she is over 18 years of age, not subject to the Child Online Privacy Act, of legal age to enter into contractual agreements in the state in which he or she is present when he or she makes this purchase, and is the true and authorized owner of the credit card used to make this purchase. Any Buyer who violates any of these requirements may be liable for civil or criminal prosecution and agrees to pay liquidated damages of an amount the equivalent of $10,000 USD per fraudulent transaction, plus actual damages, and agrees that all information collected by this website may be used for prosecution and may be turned over to law enforcement agencies or to credit card companies and merchant service providers.

If the true and/or authorized owner of the credit card attempts to commit fraud upon the Seller, he or she authorizes each and every credit card company or merchant service provider to disclose to the Seller all information that could be construed as proof of credit card fraud. Any Buyer who attempts to perpetrate a fraud upon Seller involving the use of a credit card herewith gives authorization for the Seller to access all credit information about the Buyer from credit reporting agencies and also authorizes the Seller to discover all relevant information from any source about the fraudulent practices of the Buyer and to reveal such information to credit reporting agencies, credit card companies, merchant service providers, and law enforcement agencies.

Buyer agrees that if he uses trickery to attempt to receive a refund, or if he causes a fraudulent dispute claim that results in a chargeback against the Seller’s account, that the Seller is authorized to re-charge the Buyer’s credit card that was used for the original purchase to the extent that will make the Seller whole. Buyer agrees to, in addition to actual damages, pay to the Seller liquidated damages of an amount equivalent to $10,000 USD for every separate fraudulent action Buyer commits.

4. TRC LEARNING PORTAL MEMBERSHIP(S) TRAININGS & ONLINE PROGRAMS

Upon purchase and enrollment into the chosen TRC Online Portal Membership Trainings or TRC Online Programs, you receive immediate access into the portal learning dashboard. This enables you to start your training right after completion of the purchase.

You have THREE (3) Days from the date of the original program purchase enrollment of the TRC Online Membership and/ or courses training portal to review the training content you enrolled for.

MEMBERSHIP/PROGRAM PAY IN FULL Refund requests made within the initial three day ‘cooling off’ time frame for payment in full for training portal access, will be refunded 100%. You need to submit a notice of cancellation and a refund request in writing.

MEMBERSHIP/PROGRAM 12 MONTH EASY PAY Refund requests made within the initial three day “cooling off’ time frame option for the TRC Membership and/or courses portal access, only the initial payment deposit will be refunded 100% as the first month’s payment will be the only one processed by TRC at time of enrollment.

For refunds of the TRC Membership or Courses in the portal, You need to submit a notice of cancellation and a refund request in writing. All notice of cancellation must be in writing and delivered by mail or email to ThriveRightConsulting.

Cancellation notice will be deemed on the date in which the cancellation is received by Thrive Right Consulting.

Upon completion of the refund, your access to the training content inside the TRC Training Portal and the supporting group training calls, online community accountability groups, will be revoked as those are for paid students only.

Any refund requests after the THREE (3 DAY) time limit will not be processed.

5. TRC 1:2:1 Coaching, Consulting

TRC 1:2:1 COACHING, CONSULTING VIA GOAL ACHIEVEMENT SESSIONS

Take the time to read this, please! You’ll get way more out of your coaching session and it’s important that we are on the same page when working together.
Upon purchase and enrollment into the chosen TRC 1:2:1 Coaching, Consulting packages via Goal Achievement Sessions, you receive 1:2:1 time with your TRC strategist. Your initial call is typically scheduled within the week of your enrollment purchase. During that time you and your TRC strategist will go over and book in advance your sessions. You will be given access to the private folder for the documents and communication used during the term of your contract.

Most TRC Package options for 1:2:1 Coaching, Consulting via Goal Achievement Sessions are for 6 to 12 month terms with weekly calls.

Accelerated packages are available. Talk to your TRC strategist for details and options.

Advanced scheduling enables you to start your Goal Achievement Session groundwork for session 1 during the onboarding week which starts right after completion of the purchase.

TRC 1:2:1 Coaching, Consulting via Goal Achievement Sessions deliver customized consulting and coaching for you and your company, based on proven business branding, growth, and sales strategies.

During the term of contract via the purchase of your TRC 1:2:1 Coaching, Consulting via Goal Achievement Sessions, you agree to:

1. Show up for your sessions
2. Do the inner work, and the Action Steps for growth outlined in each weekly session.
3. If by the 2nd session within the first 30 days of the initial purchase contract for your TRC 1:2:1 Coaching, Consulting via Goal Achievement Sessions, you deem to rescind your contract, you need to submit a notice of cancellation and a refund request in writing. All notice of cancellation must be in writing and delivered by mail or email.

Cancellation notice will be deemed on the date in which the cancellation is received by Thrive Right Consulting.

GOAL ACHIEVEMENT PAY IN FULL Request to rescind the contract receive a refund made within the initial 3 session time frame for payment in full for 1:2:1 private sessions, will be prorated. Refund will only be applicable to sessions not used during the term of contract. You need to submit a notice of cancellation and a refund request in writing.

Upon completion of the refund, your access to your TRC Coaching, Consulting, Training the will be terminated and your private 1:2:1 appointments opened up to other paying clients.

Any requests to rescind the contract or receive a refund after the THREE (30 DAY) time limit will not be processed.

GOAL ACHIEVEMENT SESSIONS MONTHLY PAYMENT SUBSCRIPTION Request to rescind and receive a refund made within the initial 3 session time frame for monthly subscription payments for 1:2:1 private sessions, will be prorated. Refund will only be applicable to sessions not used during the first month of service as only one month of subscription fees will have been processed by TRC. You need to submit a notice of cancellation and a refund request in writing.

Upon completion of the refund, your access to your TRC Coaching, Consulting, Training the will be terminated and your private 1:2:1 appointments opened up to other paying clients.

Any requests to rescind the contract or receive a refund after the THREE (30 DAY) time limit will not be processed.

RESPONSIBILITY UPON BECOMING A TRC CLIENT (BUYER)

*Your TRC Coach will do everything possible to support you in achieving your own results and desired outcomes
*You are responsible for the cause of all change in your life.
*TRC will work with you to identify solutions and offer suggestions, options and advice based on their own personal experience, training and the information appropriate. It is your responsibility to implement solutions to create the outcomes you desire.
*You accept full responsibility for all decisions and courses of action
*You as the buyer and Client, by approving and purchasing 1:2:1 Coaching, Consulting via Goal Achievement Sessions agree and acknowledge that the Coach is not a licensed investment advisor, real estate agent, accountant, finance, health or legal professional.

LIVE EVENTS

6. Live Events
The events, information, and speakers listed on our Sites are subject to change without notification.

You have THIRTY (30) Days prior to the event to request a full refund of your ticket price or seat deposit. Any request after the THIRTY (30) DAY time limit will not be processed. Any unused tickets will be forfeited and are not transferable to another event.

TICKET HOLDERS MAY NOT SELL, OFFER FOR SALE, OFFER AT AUCTIONS, RESELL, DONATE, ACT AS COMMERCIAL AGENT FOR ANOTHER PARTY OR OTHERWISE TRANSFER THEIR TICKETS IN ANY WAY WITHOUT THE SPECIFIC PRIOR WRITTEN CONSENT OF KERN MEDIA INC.

6.1 Ticket Transfers
Ticket transfers will not be processed THIRTY (30) Days prior to the event.
A $50 transfer fee will be applied to all ticket transfers.

6.2 Process for Guest Tickets Transfers
Once a Ticket purchase is confirmed, the Ticket Purchaser may only change the assignment of the Guests accompanying him a maximum of 2 times and using the Tickets that he purchased by: Submitting a Guest Ticket Transfer Request: the Ticket Purchaser must submit a transfer request via email to TRC.

6.3 Ticket Resales
If a Ticket Purchaser cannot use all of the Tickets that he has purchased, the Ticket Purchaser will have the opportunity to submit to Thrive Right Consulting a formal request for the resale of the Tickets he no longer wants. Written requests for the resell to be submitted via email to TRC.
There is no guarantee that demand for Tickets will result in the Tickets being resold. If the Ticket Purchaser’s Tickets are not resold, no resale proceeds will be returned to the Ticket Purchaser.

7. Live Streams
Refunds will only be provided in situations where the customer is unable to watch the Livestream due to technical issues.
Refunds will only be considered and processed on the first day of each respective event.

LIMITATION ON LIABILITY.
THE THRIVE RIGHT SOLUTIONS WEEKLY GROUP TRAINING CALLS, MASTERMINDS, PRIVATE 1:2:1 SESSIONS, DISCOVERY CALLS,  MEDIA STREAMS, LIVE EVENTS, ONLINE EVENT TRAININGS, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THRIVE RIGHT CONSULTING ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. THRIVE RIGHT CONSULTING DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE THRIVE RIGHT CONSULTING MEDIA TRAINING, LIVE STREAMs, OR LIVE ONLINE EVENTS WILL BE UNINTERRUPTED OR ERROR-FREE.

TRC is not responsible for any problems or technical malfunction of any network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or redemption to be received by TRC on account of technical problems or traffic congestion online or on the Internet or at any Web site, or any combination thereof including any injury or damage to customer’s or any other person’s computer related to or resulting from downloading or streaming any materials consistent with this agreement or subsequent use of any TRC technology platforms used for delivery of content, training and streams.

If, for any reason, the stream is not capable of running online as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of TRC. which threatens or corrupts or adversely affects the administration, security, fairness, integrity or proper conduct of a live stream offer, TRC reserves the right, in its sole discretion, to cancel, terminate or suspend the offer and/or any program, training, live event.

ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THRIVE RIGHT CONSULTING WILL DISQUALIFY YOUR ATTEMPTED REDEMPTION AND RESERVES THE RIGHT TO SEEK DAMAGES FROM YOU TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Your Account
You agree to provide accurate and complete information when you register with, and as you use with Thrive Right Consulting and you agree to update your account information to keep it accurate and complete. You agree that Thrive Right Consulting may store and use the information you provide for use in maintaining and billing fees to your Account.

9. Passwords

To use certain features of the Site, you will need a username and password, which you will receive through the Site’s registration process. You are responsible for maintaining the confidentiality of the password and account, and are responsible for all activities (whether by you or by others) that occur under your password or account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. We cannot and will not be liable for any loss or damage arising from your failure to protect your password or account information.

TERMS OF SALE ACCEPTED

Buyer expressly accepts the Terms of Sale of the Seller’s website(s).

FINAL ACCEPTANCE

By taking the affirmative step of clicking any order link on this website, and the purchasing of a product, service, or membership, you, the Buyer, attest that you have fully read, understand, and accept the terms of this site, and warrant to the Seller that said affirmative digital acceptance shall be deemed to be the same as if you had affixed your signature to a Purchase Agreement contract.
